Apple Corrects iTunes Store Math TechWeb via Yahoo News

But now million songs have gone missing. The discrepancy was noted over at Mac Network News which has posted screen shots of Apple s million song claim. The iTunes music inventory inflation appeared in a note that Apple sent to iTunes customers last week announcing that iTunes was five years old. Apple did not respond to a request for comment. Apple currently says that million songs are available through iTunes the number officially cited in Apple marketing material back through September . The iTunes Store is the world s most p! opular online music TV and movie store with a catalog of over six million songs TV shows and over films including in stunning high definition video Apple said on May . In an Aug. press release Apple said it offered over million songs through iTunes. Amazon.com in January said it sold more than . million songs through its competing MP Download service. According to an April article in The Wall Street Journal Deutsche Bank analyst Jeetil Patel estimated that Amazon s digital media initiatives have produced less than million in annual revenue despite million in investment over three years. In early April Apple said that according to data provided by the NPD Group it had surpassed Wal Mart as the leading music retailer in the United States. It said that it has sold over billion songs through iTunes worldwide in the five years of its existence. In February an NPD Group report said that Apple s iTunes Store was selling times as many MP songs as Amazon s MP Downloads service. Microsoft withdraws its bid for Yahoo International Herald Tribune

Microsoft said Saturday that it was abandoning its blockbuster bid to acquire Yahoo after it raised its offer by billion but Yahoo rejected it as still too low. The about face followed a meeting on Saturday morning in Seattle between Microsoft s chief executive Steven Ballmer and Yahoo s chief and co founder Jerry Yang according to a person familiar with the talks. At the meeting which also included Yahoo s other founder David Filo and a Microsoft president who oversees its online unit Kevin Johnson Ballmer increased Microsoft s offer to a share or a total of about . billion from . a share. Yang told Ballmer that Yahoo would not accept an offer below a share this person said. Despite our best efforts including raising our bid by roughly billion Yahoo has not moved toward accepting our offer Ballmer said in a statement. After careful consideration we believe the economics demanded by Yahoo do not make sense for us and it is in the best interests of Microsoft stockholders empl! oyees and other stakeholders to withdraw our proposal. A person close to Yahoo said the price was not the only stumbling block. The person said Yahoo was also concerned that the deal could be blocked by regulators and wanted a higher offer in part as a hedge against that risk. The breakdown in the talks is likely to send Yahoo s shares plunging and Yang and his team will have to decide how to placate investors. The company has been exploring alternatives to a marriage with Microsoft including a partnership in search advertising with its arch rival Google which could lift Yahoo s profit and perhaps its stock price. Yahoo has also discussed possible mergers with the AOL unit of Time Warner and the MySpace unit of the News Corporation! . The MySpace talks have not been active of late. But both remaining options pose challenges. A Google partnership would be likely to attract scrutiny from regulators because of Google s dominance over online search and advertising while AOL and Yahoo have many overlapping businesses and technologies making a merger difficult. In a statement issued late Saturday Yang said With the distraction of Microsoft s unsolicited proposal now behind us we will be able to focus all of our energies on executing the most important transition in our history. Reactions inside Yahoo are likely to be mixed. Several senior executives favored selling to Microsoft and said in recent days that they were hoping to see a deal happen. Yet other executives were high fiving each other for defeating Microsoft s bid people close to the company said. While its stock may fall on Monday Yahoo s management was encouraged by discussions with its largest investors in which they urged management to not accept a share these people said. For Yang Microsoft s withdrawal is consider! ed a personal victory according to one person who spoke with him. Microsoft has spent years and billions of dollars trying to build an online business. Yet it has steadily lost ground to Google in the search business and has failed to gain significant momentum with advertisers. Microsoft s decision to abandon its pursuit of Yahoo is not necessarily the last chapter in the three month old saga. If Yahoo s shares fall significantly the company will be under intense pressure to act and may choose to resume negotiations. Earlier this year under intense shareholder pressure BEA Systems did just that agreeing to a takeover by Oracle soon after Oracle dropped an unsolicited offer it had made for BEA. This seems like a very strong but serious negotiating tactic said Jonathan Miller the former chairman and chief executive of AOL. It will be up to Yahoo to come back to the negotiating table. Microsoft had threatened to pursue a hostile takeover if it could not come to an agreement wi! th Yahoo s management. That could have involved an appeal directly to Yahoo s shareholders and an effort to remove members of Yahoo s board of directors. In a letter to Yang sent on Saturday afternoon Ballmer wrote It is clear to me that it is not sensible for Microsoft to take our offer directly to your shareholders. This approach would necessarily involve a protracted proxy contest. He added Our discussions with you have led us to conclude that in the interim you would take steps that would make Yahoo undesirable as an acquisition for Microsoft. Ballmer took particular aim at Yahoo s discussions of a partnership with Google noting that it would make an acquisition of Yahoo undesirable to us for a number of reasons. Formula Set for Web Music Royalties Time Magazine

A federal court on Wednesday established a formula for determining the Internet royalties owed to thousands of music composers writers and publishers by three major online services Yahoo Inc. AOL and RealNetworks Inc. Related Articles The American Society of Composers Authors and Publishers hailed the decision estimating the guidelines could yield as much as million in payments covering a seven year period ending in . The trade group known as ASCAP had contended that its members weren t being properly compensated for musical works that helped drive traffic and increase revenue for Yahoo Time Warner Inc. s AOL and RealNetworks. Wednesday s ruling issued by a federal judge in New York doesn t affect the royalties owed to record companies. A representative for the Digital Media Association a trade group representing the Internet services declined to comment on the ruling. U.S. District Judge William Conner s page decision didn t specify the total amount owed to the ASCAP member! s but he provided an example on how the formula would apply to the music royalties owed by AOL and Yahoo for . Under the formula endorsed by Conner AOL owed fees of . million and Yahoo owed . million. That s far more than AOL and Yahoo envisioned. New York based AOL had proposed paying just in royalties while Sunnyvale based Yahoo had proposed paying in licensing fees according to court documents. Conner s estimates were slightly less than what ASCAP had sought from the Internet services. Lohans new album set for release in the Fall

Contrary to rumors that Lindsay Lohan has caused serious delays on her upcoming album fans can expect to hear the singer actress crooning on the radio in the next few months say those in her inner circle. She already has four songs completed . It ll be a fall release and they re looking to sneak a single to radio this summer a source close to Lohan tells PEOPLE. The star s rep denies recent reports that Lohan has not been cooperative and canceled important meetings. There s no truth to it says the rep. Reports claimed Lohan blew off several meetings with Grammy winning producer Timbaland but the source close to Lohan says she s hard at work on the album and denies the meetings were ever set up though Lindsay would love to work with him the source adds. A rep for Timbaland confirms that he was never scheduled to work with Lohan. A Universal Music Group spokesman told PEOPLE in a statement Recent reports about Lindsay Lohan and the status of her upcoming album are completely a! nd factually untrue. What is true is that she continues to be extremely focused and hard at work on the project. And as a company we are looking forward to releasing the album when she is done

Reportedly the outfit was able to record a downlink transmission rate of Mbps over a high speed wireless network in an outdoor test of an experimental Super G system and while it s not quite the Mbps we d heard about before you won t find us kvetching. File this under Wake me up when it gets here . I know all of this stuff is coming but when I m sorry but G still seems sluggish to me.
